These Terms and Conditions ("Terms") govern your use of the Actics Wellness website at https://acticswellness.com/ and the Actics Fitness Academy learning platform (together, the "Platform"). The Platform is operated by Actics Global Private Ltd, trading as Actics Wellness, registration number PV 00341308, of No. 334/1, Batagama South, Kandana, Sri Lanka ("Actics", "we", "us" or "our"). By browsing the Platform, creating an account or buying a course, you agree to these Terms. If you do not agree, please do not use the Platform.
1. Who can use the Platform
You must be at least 18 years old to create an account or make a purchase. Users aged 16 or 17 may use the Platform only with the consent and supervision of a parent or guardian, who accepts these Terms on their behalf. The Platform is not intended for children under 16.
2. Your account
You need an account to buy a course, save learning progress or earn a certificate. You agree to give accurate information, keep your password confidential and tell us promptly at acticsfitness@gmail.com if you suspect unauthorised use. You are responsible for activity under your account. Each account is for one person only and may not be shared, sold or transferred.
3. Our courses and services
Actics Fitness Academy offers online fitness education programs, currently Aesthetic Body, Functional Strength, Mobility and Running, along with bundles of these courses. Programs include lessons, demonstration videos, workouts, downloadable resources, knowledge checks, progress tracking and certificates of completion. We may offer coaching programs and other services in future; additional terms may apply to those and will be shown before purchase.
Some courses may be released in stages or offered before all content is published. The course page will state what is currently available and what is planned.
4. Languages
The Platform is available in English, Sinhala and Tamil. Not all content may be available in every language at the same time. Where a translation is not yet available, we will tell you clearly and offer the version that exists. If there is any inconsistency between language versions of these Terms, the English version prevails.
5. Prices and payment
Prices are shown on the Platform in Sri Lankan Rupees (LKR) or another stated currency, and include any applicable taxes unless stated otherwise. Prices, bundles and promotions may change at any time, but a change will not affect an order you have already paid for.
Payments are processed by third-party payment providers such as PAYable Sri Lanka. We do not see or store your full card number or security code. Your course access is activated only after the payment provider confirms the payment to us. Reaching a "payment successful" page in your browser alone does not activate access. If a payment fails or cannot be verified, no enrollment is created.
Promotional codes and discounts are subject to the conditions shown with them, cannot be exchanged for cash and cannot be applied after a purchase is complete unless we state otherwise.
6. Your licence to use course content
When you buy a course, we grant you a personal, non-exclusive, non-transferable licence to access and use that course for your own non-commercial learning. Access lasts for as long as the course remains available on the Platform and, in any case, for at least 12 months from the date of purchase. If we retire a course after that period, we will give you at least 30 days' notice so you can download any available resources.
You may not:
- share your login or allow others to access your courses;
- copy, record, download (other than resources we provide for download), redistribute, resell or publicly display course content;
- use course content to run classes, coaching or other commercial services;
- remove watermarks, copyright notices or certificate security features; or
- attempt to bypass access controls, payment verification or assessment rules.
All course content, videos, text, graphics, worksheets, the Actics name and logo, and the Platform software belong to Actics or our licensors and are protected by intellectual property law. Buying a course does not transfer ownership of any content to you.
7. Health and safety disclaimer
Our programs provide general fitness education. They are not medical advice, diagnosis or treatment, and they do not replace individual advice from a doctor, physiotherapist, dietitian or other qualified professional.
Before starting any exercise or nutrition program, you should consult a qualified healthcare professional, especially if you are pregnant or recently gave birth, have a heart, lung, joint, metabolic or other medical condition, have an injury, take regular medication, or have been inactive for a long period.
You are responsible for training within your own limits, using appropriate equipment and a safe environment, and following the modifications provided. Stop exercising immediately and seek medical help if you experience chest pain, dizziness, faintness, unusual shortness of breath, or sharp or worsening pain.
Nutrition content is educational and is not an individual meal plan or a treatment for any medical condition.
8. No guaranteed results
Results depend on many individual factors, including your starting condition, consistency, recovery, nutrition and health. We do not guarantee any particular change in physique, body weight, strength, mobility, running performance or health. We do not claim that our programs prevent injury, reduce fat in specific body areas or treat any medical condition. Any examples or testimonials describe individual experiences and are not typical or promised outcomes.
9. Assessments and certificates
Each course sets out the requirements for a certificate, such as completing lessons, achieving a minimum quiz score and submitting practical assignments. Completion requirements are checked by our system and cannot be changed by the learner.
A certificate of completion confirms that you completed an Actics Fitness Academy course. It is not a professional qualification, licence or accreditation to train others, unless we expressly state otherwise. Each certificate has a unique ID and can be checked on our public verification page, which shows only the information needed to confirm authenticity.
We may revoke a certificate if it was obtained through cheating, account sharing, misrepresentation, a refunded or reversed payment, or a breach of these Terms.
10. Your data and progress records
We handle your personal information in line with our Privacy Policy at https://acticswellness.com/privacy-policy. Body measurements, progress photographs and workout notes are optional, kept private by default and never required to complete a course. You can ask us to access, correct or delete your personal information as described in the Privacy Policy.
11. Acceptable use
You agree not to use the Platform to break any law, upload harmful code, harass other people, impersonate anyone, scrape or copy content at scale, interfere with the Platform's security or operation, or make fraudulent payments or chargebacks.
12. Platform availability and changes
We aim to keep the Platform available and secure, but we do not guarantee uninterrupted access. We may carry out maintenance, update the Platform, and improve or correct course content. Updates may change lessons, but will not remove the core learning outcomes of a course you have bought. Your past assessment results and certificates are preserved when content is updated.
13. Suspension and termination
We may suspend or close your account if you seriously or repeatedly breach these Terms, share your account, infringe our intellectual property, or act fraudulently. Where reasonable, we will warn you first and give you a chance to fix the issue. If we close your account for a breach, you will not be entitled to a refund except where required by law. You may close your account at any time, as described in our Cancellation Policy.
14. Refunds and cancellations
Cancellations by customers are non-refundable. Refunds are available only in the limited cases set out in our Refund Policy, and cancellations are handled under our Cancellation Policy. Both form part of these Terms.
15. Limitation of liability
Nothing in these Terms limits any rights you have under Sri Lankan consumer protection law, or our liability for death or personal injury caused by our negligence, or for fraud.
Subject to that, we are not liable for injury, illness or loss arising from your decision to perform exercises or follow nutrition guidance without appropriate professional advice, or from failing to follow the safety guidance and modifications provided. We are also not liable for indirect or consequential losses, or for interruptions caused by events beyond our reasonable control, such as internet, power or payment provider failures.
Our total liability to you for any claim relating to a purchase is limited to the amount you paid for the course or bundle concerned.
16. Third-party services
The Platform uses third-party services, including payment providers, video hosting and email delivery. Your use of those services may also be subject to their own terms. We are not responsible for third-party websites linked from the Platform.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new effective date and, for significant changes, notify registered users by email or on the Platform. Changes do not apply retrospectively to purchases already made.
18. Governing law and disputes
These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. If you have a complaint, please contact us first at acticsfitness@gmail.com so we can try to resolve it. If we cannot resolve it, the courts of Colombo, Sri Lanka, will have jurisdiction, without affecting any right you have to bring a claim in your local courts or to complain to the Consumer Affairs Authority.
